How Spouse and Partner Sponsorship Works

Canada’s spousal sponsorship program falls under the Family Class and is administered by Immigration, Refugees and Citizenship Canada (IRCC). It allows a Canadian citizen or permanent resident to sponsor their spouse or partner for permanent residence, so the two of you can build a life together in Canada.

Canada recognizes three types of relationships for sponsorship purposes, and all three include same-sex couples:

Relationship TypeWhat It Means
SpouseYou are legally married. The marriage must be valid under the law of the country where it took place and under Canadian law.
Common-Law PartnerYou are not married, but you have lived together in a conjugal relationship for at least 12 consecutive months. Short separations for work or travel can be acceptable, but the cohabitation must be continuous.
Conjugal PartnerYou have been in a committed relationship for at least one year but have not been able to live together or marry due to circumstances beyond your control, such as immigration barriers, religious restrictions, or political conditions in one partner’s country.

The program has two streams. Outland sponsorship is processed through a visa office abroad and is currently available regardless of whether the sponsored person is inside or outside Canada. Inland sponsorship is for couples who are already living together in Canada, and it allows the sponsored person to apply for a spousal open work permit while the permanent residence application is being processed.

Both streams lead to permanent residence and the choice between them affects processing timelines, work permit eligibility, and appeal rights if the application is refused. Choosing the wrong stream can cost you time and decrease your options. If you are unsure which stream fits your situation, that is one of the first strategies that we will develop in a consultation.

If you plan to settle in Quebec, be aware that the province has its own sponsorship requirements under the Canada-Quebec Accord, including a separate undertaking and, at times, intake limits on certain categories.

Who Can Sponsor and Who Can Be Sponsored

Both the sponsor and the sponsored person must meet requirements set by IRCC. The rules cover who can act as a sponsor, which relationship types qualify, and circumstances that would prevent a sponsorship from going forward.

Canadian Citizen or Permanent Resident, 18+

You must be a Canadian citizen or permanent resident and at least 18 years old. Citizens can sponsor from outside Canada if they demonstrate intent to return once their partner receives permanent residence, however, permanent residents have the limitation that they must be living in Canada while the application is processed.

Genuine Relationship

IRCC assesses whether your relationship is genuine and was not entered into primarily to gain immigration status. This is the central question in every spousal sponsorship application. Officers review the evidence you submit, including how you met, how your relationship developed, and how you maintain it. The strength of this evidence is often what separates approved applications from refused ones.

No Prior Sponsorship Bars

If you were previously sponsored as a spouse or partner yourself, you cannot sponsor someone else until five years after you became a permanent resident. If you previously sponsored a different spouse or partner, you must wait until three years after that person received permanent residence.

No Criminal, Financial, or Legal Bars

You cannot sponsor if you have an undischarged bankruptcy, are in default on a previous sponsorship undertaking or immigration loan, are under a removal order, are in prison, or have been convicted of certain violent or sexual offences against a family member.

No Minimum Income Requirement

Unlike a parent and grandparent sponsorship, spousal sponsorship does not require the sponsor to meet a minimum income threshold. However, you must not be receiving government social assistance for reasons other than disability. There is one exception: if your sponsored partner has a dependent child who also has their own dependent children, a minimum income requirement based on the Low Income Cut-Off (LICO) does apply.

Situations that commonly prevent sponsorship

Being in default on a prior undertaking, having an undischarged bankruptcy, being under a removal order, receiving non-disability social assistance, failing to meet court-ordered support obligations, or having a previous sponsorship still within its bar period.

Documents You Will Need for Your Application

A spousal sponsorship application tells the story of your relationship through documents and evidence. The documentation goes well beyond filling out forms. What you include, how it is organized, and how thoroughly it covers your history together can directly affect processing time and outcome.

Proof of Your Relationship

Marriage certificates, common-law statutory declarations, or evidence supporting a conjugal partnership claim. Common-law couples need documents showing at least 12 consecutive months of cohabitation, such as a shared lease, joint utility bills, or joint bank statements.

Relationship Genuineness Evidence

Photos of you together over time, chat and call logs, emails, records of visits, letters from friends and family who know you as a couple, and anything else that shows your relationship is real and ongoing. This is the most important category in the application.

Identity and Status Documents

Passports, birth certificates, proof of Canadian citizenship or permanent residence for the sponsor, and national identity documents for the sponsored person. Include certified copies where IRCC requires them.

Police Clearance Certificates

Both the sponsor and the sponsored person need police certificates from every country where they have lived for six months or more since turning 18. These establish admissibility to Canada and can take weeks or months to obtain from some countries.

Immigration Medical Examination

The sponsored person must complete a medical exam with an IRCC-designated panel physician. Results are submitted directly to IRCC and are valid for 12 months, so timing the exam relative to your submission date matters.

Financial and Supporting Documents

Proof that you are not receiving non-disability social assistance and can meet the basic needs of the person you are sponsoring. If the LICO income requirement applies to your situation, you will also need tax documents such as Notices of Assessment.

How the Maple Team Handles Your Sponsorship

Step 1: Assessment and Consultation

We review your full situation: the type of relationship, where you and your partner are located, any past immigration history, and anything that could affect the application. You leave with a clear picture of your eligibility, which stream makes sense, and what to expect from the process.

Step 2: Building Your Document Package

We help you gather and organize every piece of evidence the application needs. At Maple, we go well beyond the government checklist to make sure the file is thorough and leaves no room for an officer to request more information, which is one of the most common causes of delay.

Step 3: Application Build and Review

We assemble the application, prepare supporting statements, and review every form and document for accuracy and completeness before submission. A well-organized, comprehensive file is the single best thing you can do to keep processing on track.

Step 4: Submission and Representation

We submit your application to IRCC and act as your authorized representative for the duration of processing. If the government requests additional information or documents, we handle the correspondence on your behalf so nothing falls through the cracks.

Step 5: Through to Permanent Residence

We stay with your case through the approval and landing process, including the spousal open work permit application if applicable, and help you prepare for your partner’s arrival and settlement in Canada.

Why Work With a Consultant on Sponsorship

Spousal sponsorship is one of the most emotionally important immigration applications you will ever make, and one of the most document-intensive. The genuineness test at the centre of every case means that the quality and organization of your evidence matters as much as the facts themselves. An officer who receives a thin, disorganized file with gaps in the relationship timeline will ask questions. Those questions add months.
The most common reasons applications run into trouble have nothing to do with whether the relationship is real. They come from incomplete evidence, poorly chosen documentation, forms filled out inconsistently, or a file that simply does not tell the story clearly enough for an officer who reviews hundreds of cases. A single inconsistency, even an honest mistake on a form, can trigger a closer look or a request for additional documents.
At Maple Immigration Services, spousal and family sponsorship is what we do the most and know the best. Brandon Miller and The Maple Team have helped couples from across Canada and around the world build applications that represent their relationships accurately and thoroughly. We know what officers look for, what raises flags, and what kind of evidence resolves questions before they are asked. Our practice is to submit more than the checklist requires, so the officer who opens your file has everything they need to make a decision.

We also understand what couples go through during the wait, and it is at this point that we see most people really experience a lot of anxiety about their application. After the application is submitted, processing can feel like a black box, and you are left with limited understanding and visibility of what is actually happening behind the scenes. Having a professional to call when you need context or reassurance is a large part of what clients tell us they value.

If you are considering spousal sponsorship, a consultation is the right place to start. We will tell you honestly where you stand and what it would take to move forward.

Common Questions About Spousal Sponsorship

No. There is no language requirement for the sponsored person in a spousal sponsorship application. Unlike Express Entry or citizenship, IRCC does not require language test results from a sponsored spouse or partner.

Processing times depend on the stream you apply under, the visa office handling your file, and how complete your application is. IRCC publishes updated processing times regularly. As a general reference, outland applications have recently been processed faster than inland applications, though both timelines can vary. Check IRCC’s processing times page for the most current estimates. A thorough, well-organized application with no missing documents is the best way to avoid the delays that come from government requests for more information.

Yes. Canada fully recognizes same-sex marriages, common-law partnerships, and conjugal partnerships for immigration purposes. Same-sex couples apply through the same process and are assessed under the same criteria as any other couple.

IRCC evaluates whether your relationship is genuine and was not entered into primarily for the purpose of gaining permanent residence. Officers review the evidence you submit, looking at how you met, how your relationship developed over time, how you communicate, and whether you have a shared life together. This assessment applies to all three relationship categories. The strength and consistency of your relationship evidence is the single most important factor in a spousal sponsorship application.

If you are a Canadian citizen, yes, you can sponsor from abroad, but you must demonstrate that you intend to return to Canada once your spouse or partner receives permanent residence. This is a very important factor that must be taken into account for an application. If you are a permanent resident, you must be physically living in Canada while the sponsorship application is being processed.

Your options depend on which stream you applied under. If you applied through the outland stream, you have a right of appeal to the Immigration Appeal Division (IAD), which is a meaningful protection in cases where an officer may have overlooked evidence or made an error. If you applied through the inland stream, a formal appeal is generally not available, and you would need to reapply or pursue a judicial review. Choosing the right stream at the outset is one of the reasons professional guidance matters.

In most cases, no. Spousal sponsorship does not have a minimum income requirement. The main financial condition is that you must not be receiving government social assistance for reasons other than disability. The one exception is a narrow situation where the sponsored spouse or partner has a dependent child who also has their own dependent children. In that case, the sponsor must meet the Low Income Cut-Off (LICO) for the size of the family.

When you sponsor a spouse or partner, you sign a legally binding undertaking to financially support them for three years from the date they become a permanent resident. This means you are responsible for their basic needs during that period, even if your relationship ends. If the person you sponsored receives government social assistance during the undertaking period, you may be required to repay it. The undertaking cannot be cancelled or shortened once your partner becomes a permanent resident. In Quebec, the undertaking period for spouses and partners is three years, matching the rest of Canada, though Quebec has its own separate undertaking form and process.

Find Out Whether Sponsorship Applies to You

Every couple’s situation is different and this is the most important aspect to any application. Even if you read something online about another person’s situation, there are many factors that will make yours different. If you are thinking about sponsoring your spouse or partner, the first step is a conversation about your specific circumstances, your options, and what to expect from the process. We will tell you honestly where you stand and give you the insight in the beginning to make informed decisions going forward.
